Ansett loses toxic fumes appeal

Ansett Australia has failed in its bid to stop a former flight attendant suing over claims she was exposed to toxic fumes on some of its aircraft.

Deborah Elizabeth Carter is suing the airline for damages for personal injuries she says she suffered as a result of alleged exposure to toxic chemicals in the cabins of its BAE 146-200 planes.

It was alleged she suffered headaches, a skin complaint, severe pharyngitis and extreme lethargy as a result of the exposure.

The airline argued in the Court of Appeal in Brisbane that the Queensland District Court erred in extending the period of limitation in an action for damages of this kind.

The court dismissed the appeal with costs.
